Organic Chemistry Tutoring offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.

By visiting our site and/ or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Purpose

 

1. The following document outlines the general terms and conditions that clients (you) agree to when ordering services from us.

2. By ordering any services from us, you confirm that you have read, understood, and agreed to the following terms and conditions.

 

Purchases

 

If you wish to purchase any product or service made available through the Service ("Purchase"), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

 

You represent and warrant that:

• you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that

• the information you supply to us is true, correct and complete.

 

The service may employ the use of third-party services to facilitate payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order, or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.

 

 

Limitations Of Service

 

All downloadable materials are offered "as is" and may be subject to future modifications. Previous purchases do not grant access to the newer editions of the handouts, notes, practice tests, or other downloadable materials.

 

Access to Purchased Downloadable Materials

 

Access to downloadable materials is only available via the download links. Once you make a purchase, you'll receive an email confirmation with the download links for your purchased downloadable materials. If you opt to make an account with us during the checkout or already have one, you may also access the download links via your account page. All download links expire automatically after 30 days from the original purchase. Unreliable internet connection and large public networks may corrupt large files. It is your responsibility to ensure you are using a reliable internet connection and downloading files one at a time to help avoid this issue. We will grant the link permission regenerations at our sole discretion.

 

Cancellation and Refund Policy

 

Payments for tutoring services are non-refundable except in cases where proof of an emergency can be provided. A payment for a single appointment is made during session booking. Session cancellation requires at least 24 hours' prior notice. Any rescheduling request is considered a cancellation and a subsequent scheduling of a new appointment. Rescheduling is free and is subject to the tutor's schedule and availability. Downloadable materials are non-refundable.

 

 Refund Requests For Downloadable Materials

 

• We will only issue a refund for downloadable materials in the case of an erroneous double charge.

 

• A refund request must be received no later than 24 hours after the purchase date.

 

• If you would like to request a refund, please email chemistry369@outlook.com.

 

Refunds will be offered at our sole discretion. By purchasing educational materials from our site, you agree to this refund policy and relinquish any rights to subject it to any questions, judgment, or legal actions. We are not liable to cover any differences in exchange rates between the time you purchased and the time you are refunded.

 

Accounts

 

When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

 

You are responsible for maintaining the confidentiality of your account and password, including but not limited to restricting access to your computer and/or account. You agree to accept responsibility for any activities or actions under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any security breach or unauthorized use of your account.

 

You may not use the name of another person or entity as a username that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders at our sole discretion.

 

Termination

 

We may remove or suspend your account and restrict access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

All provisions of the Terms that should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

 

Indemnification

 

You agree to defend, indemnify and hold harmless Organic Chemistry Tutoring and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.

 

Limitation of Liability

 

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time, we may pause or disconnect the service for unspecified periods or cancel the service at any time without notifying you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties.

The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Organic Chemistry Tutoring and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components, or d) the results of using the Service will meet your requirements.

 

Exclusions

 

Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you.

 

Governing Law

 

These Terms shall be governed and construed by the laws of Canada and the United States without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held invalid or unenforceable by a court, the remaining provisions will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service. We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you disagree with the new terms, you can no longer use the Service.
